General conditions

The contractual document that will govern the contracting of journey reservations through the website is set out below. The acceptance of this document implies that:

The BUYER has read,  understands and agrees with this text.
The BUYER is a person or entity with sufficient capacity to contract.
The BUYER assumes all the obligations set forth herein.

These conditions will have an indefinite validity period and will be applicable to all contracts made through the SELLERs website.
THE SELLER reserves the right to unilaterally modify said Conditions, without this affecting the reservations that were acquired prior to the modification.

1. IDENTITY OF THE PARTIES

On the one hand, THE SELLER or supplier of the goods is ARRIVA GALICIA, S.L., with registered office at Avda Quinta S/n, Bloque E, Portal 17, Polígono de Pocomaco – Mesoiro, 15190 A Coruña, with NIF B82387176, and on the other,
The BUYER, registered on the website through a form for creating an account on web, over which they have full responsibility for the use and custody, being responsible for the veracity of the personal data provided to the SELLER.

2. OBJECT OF THE CONTRACT

The purpose of this contract is to regulate the contractual relationship of purchase and sale born between the SELLER and the BUYER at the moment in which the latter checks the box confirming that he has read and accepts the General Conditions of Purchase and the Privacy Policy, and presses the button purchase.

The contractual relationship of sale entails the delivery, in exchange for a certain price and publicly exposed through the website, of a reservation of a journey.

3. MINIMUM CONTRACTING AGE

According to art.1263 of the Civil Code, non-emancipated minors and the disabled cannot enter into distance sales contracts without the express consent of their parents or guardians.

By accepting these general conditions of sale, the Client declares that they are of legal age (at least 18 years old) and have the legal capacity to acquire the services and/or products offered through this website, and that they understand and agree with the general conditions in its entirety.

4. CONTRACTING PROCEDURE

The contracting procedure may be carried out in the Spanish and Galician languages ​​once you have selected the products with the data requested in the shopping cart and completed the form for creating an account or purchasing without registration, you are informed (in accordance with what is required by article 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce and other affected regulations) that the contracting procedure is carried out once the following steps have been carried out:

1. In order to make the online purchase, it is necessary to register as a user and complete a small form with identification data, such as name, surname and email.
2. Once registered, we select in the section Schedule regular lines, the station of origin and destination and date and press the search button.
3. On the next screen you must choose the available time where the price will also be indicated (with taxes included).
4. Once the buy button has been pressed, a new window will open where it will show the data and confirmation to continue with the purchase. In this section we will have the option to select more or less quantity of the tickets already chosen.
5. Once the contracting terms and the privacy policy have been accepted, the user will be redirected to the payment gateway of the bank where the payment will be made. Once satisfied, we press the buy button.
6. Once the payment is complete, you will receive a ticket locator code and a QR by mail.
7. Once the payment has been made, the tpv will redirect you back to the website where you can continue browsing.

The SELLER will file the order in its information systems so that the BUYER, registered in website, in the client area can have access, among other things, to the details and status of their order, as well as their purchase history.

5. PRICE AND TERM OF VALIDITY OF THE OFFER

The prices indicated for each product include the Value Added Tax (VAT, 10% for these services) and in any case will be expressed in the Euro currency (€).

The prices applicable to each route will be those published on the website and applied automatically by the contracting process in its last phase.

THE SELLER reserves the right to modify the commercial offer of the website, at any time, although said modifications will not apply to contracts already made.

For any information about the order, the BUYER may contact via email to the e-mail address atencioncliente@arriva.es. In any case, the reservation or ticket number that was assigned and indicated in the purchase confirmation email must be indicated in the subject of the message or to the customer service centre.

6. CANCELLATIONS AND CHANGES

The BUYER may cancel the service if requested within 24 hours before the start of the service. The registered user will have a ticket cancellation functionality in their client area and the unregistered user will have a screen on the website where they can enter the location data of their ticket and proceed to cancel it. Regardless of these resources, the user can contact Arriva customer service, both by phone and in person, and cancel their ticket.

Tickets paid for with a financial card can only be canceled against the card with which the purchase was made.

The non-presentation of the traveler at the place and time of departure will lead to the loss of the trip and will not give the right to change the ticket or refund its amount.

The BUYER may change the service ticket up to 24 hours before its departure and only on working days and hours, to do so they must do so exclusively through Customer Service by telephone, providing all the data referring to the ticket to be changed. The amount of the new ticket can only be equal to or less than the one replaced and if it is less, the difference in price will not be refunded.

7. INVOICE

If you want an invoice for your tickets, you can contact the Arriva Customer Service.

8. MEANS OF PAYMENT

The payment of the price of the products purchased can be made through any of the following cards accepted as a means of payment: Visa, Visa Electron, MasterCard or other similar credit/debit cards.

For payment by card, the BUYER must follow each and every one of the instructions that appear on the corresponding screen, providing the following information:

a) Card number
b) Expiration date.
c) Card Verification Code (CVC).

9. DATA PROTECTION

In accordance with the provisions of the personal data protection regulations, you are informed that they will be processed and incorporated into a processing activity, the purpose of which is the correct management and maintenance of the contractual relationship derived from the purchase and sale of the ticket. transport. The legitimacy for the treatment of your data is the execution of a contract.

The data provided will be kept for the time necessary to comply with legal requirements and to determine the possible responsibilities that may arise from said purpose and from the processing of data and data will not be transferred to third parties except legal obligation.

10. COMPLAINTS AND CLAIMS

In any case, the order number must be indicated in the subject of the message. was assigned to you and indicated in the purchase confirmation email.

There is also a complaints book in the companys offices and lockers available to the user public.

11. APPLICABLE LAW AND JURISDICTION

These conditions will be governed or interpreted in accordance with Spanish legislation in what is not expressly established. The SELLER and the BUYER agree to submit any dispute that may arise from the provision of the services covered by these Conditions to the Courts and Tribunals of the BUYERs domicile or to the Galician Transport Arbitration Board. In the event that the buyer is a company or professional, the contract shall be presumed to be held at the SELLERs address.

In the event that the BUYER is domiciled outside of Spain, the SELLER and the BUYER expressly waive any other forum, submitting to the Courts and Tribunals of the SELLERs domicile.
